Labour Welfare Department

The Department is named as Labour Welfare Department which was earlier known as Labour & Employment Department. It runs under the State Govt. of Assam. The overall administrative authority of the Department is the Labour Commissioner, Assam under whom zonal works offices are there under the Head of Assistant Labour Commissioner who controls the Labour Officers/Labour Inspectors at District/Sub-division level. The Asst. Labour Commissioner and the Labour Officer are authorized to implement as the Registering Officer/Licensing Officer under various Labour Laws and the Labour Inspectors are appointed as registering officer under the Assam Shops & Esstt. Act and Inspector under different Labour Laws: -

  1. Issuance of Certificate of registration and renewal thereon under the Assam shops & Esstt. Act.
  2. Issuance of Licenses and renewal thereon under the Contract Labour Act.
  3. Issuance of certificate of registration under Motor Transport Workers Act.
  4. Disposed of dispute under Industrial Dispute Act.
  5. Dispose of complains under Employees compensation Act.

In order to obtain the above mentioned services the eligibility criteria are as follows:  

  1. For issuance of certificate of registration and renewal thereon under the Assam Shops & Esstt. Act.: - An applicant must have his shop/commercial esstt./ entertainment places within the areas of municipality/town committee/other extended areas as notified by the Government under Karimganj  Sub-Division and he is to submit an application in form “O” along with depositing the requisite fees under Head of Account 0230 ,101 through the treasury challan (to be passed by departmental officers) And after due scrutiny if the registering officer satisfied the certificate of the registration is usually issued to the applicant.
  2. For issuance of license and renewal thereon under the Contract Labour Act:- An applicant being a contractor is to submit application in form “IV” under the said act along with form “V” issued by the principal employer and deposit the requisite fees, security deposit as prescribed under the rules of the said Act. After due scrutiny of the application “VII” along with enclosures the licensing officer i.e Asstt. Labour Commissioner issues License in form “VI” to the concerned applicant i.e. a contractor.
  3. For issuance of certificate of registration under Motor Transport Workers Act.: - The applicant being the owner of a commercial vehicle is to apply for registration of his vehicle under the said Act on form “Application for registration of renewal of certificate of registration” along with requisite fee through treasury challan to the registering officer i.e. Asstt. Labour Commissioner and if the registering officer satisfied about the illegibility issues certificate of registration whose validity is up to 31st December of the said calendar year and thereafter to renew the same for a further period of one year.
  4. For Disposed of dispute under Industrial Dispute Act:- Under this Act, if any complaint is received from a worker or a group of worker employing in any industry the Labour Inspector or the Asstt. Labour Commissioner (as case may be) hold a discussion/conciliation inviting both the workers and the employers for amicable settlement/dispose of.
  5. For Dispose of complains under Employees Compensation Act: - Under this Act application are received from the injured employee/nominee of the deceased employee usually within 2 years from the date of occurrence of the accident during the period of employment and the Asstt. Labour Commissioner being the commissioner under this act disposes of the petition claiming compensation through various steps.

The fees for registration/ licence are deposited through treasury challan.

The supporting documents are required on the basis of the Acts under which the applications are received.

There is no any time line for submitting the application. Only in case of renewal, the applications for renewal is to be submitted before expiry of the validity. Otherwise the applicant are to deposit late fee (in some cases where applicable.)

The applications are disposed of after due scrutiny of the same within 10 to 15 days.

Prohibition of Child Labour :

The Child  and Adolescent Labour Act,1986 prohibits the children below the 14 years to work in any hazardous and non hazardous establishments. In order to detect such child Labourers, District Level child Labour Task Force committee , is  constituted under the Chairmanship of the Deputy  Commissioner along with the members from Labour Welfare Department ,Social Welfare Department as well as stake holder social workers,  CWC etc. The Committees visit the child Labours prone establishment and rescue the engaged child Labour from the concern establishments and hand over to the CWC and the CWC after duly examining them by the Health Department regarding their ages, the CWC there after take  them to shelter houses as well as institutions under NCLP (where available).

In respect of Adolescent Labourers i.e those who are above the age of 14 years & below the age of 18 years are prohibited to engage in hazardous works i.e. they  may be employed in only non hazardous works and their working hours must not be more than 6 hours in a day and must be facilitate with schooling   and other facilities as provided under the said Act.

Mean while the Labour Welfare Department issues show cause notices to the recalcitrant employers and after receiving the replies, if the authorise Inspector feels deem about the actual engagement of Child Labour ,he files complains against the employer concern for violation of the aforesaid Act before the Hon’ble Court of the chief  Judicial Magistrate of his respective area .
